Srinagar, June 26(KNB): The Jammu & Kashmir Cricket Association (JKCA) has declared the notice issued by suspended President Javid Ahmad Kitab for convening a Special General Meeting (SGM) on June 27 as “wholly unauthorised” and without any legal authority, while directing all members and stakeholders not to act upon it.
According to an official notification issued by the JKCA Apex Council, Javid Ahmad Kitab was placed under interim suspension from exercising the powers, functions and responsibilities of the office of President through a resolution passed on June 25, pending an inquiry and adjudication by the Ombudsman. The notification states that the decision was taken under Rule 23(i) of the JKCA Constitution.
Following the suspension, the Apex Council notified that Vice President Desh Rattan Dubey has assumed charge as the Officiating President of the Association with immediate effect under Rule 15(b) of the Constitution. He will exercise all powers and discharge all responsibilities attached to the office of the President until the Ombudsman’s decision or for a period of six months, whichever is earlier. The notification further directs all office bearers, affiliated units, committees, councillors, employees and stakeholders to recognise his authority and extend full cooperation.
In a separate notice issued on Friday, the Officiating President stated that despite the suspension, Javid Ahmad Kitab purportedly issued a notice convening a Special General Meeting on June 27. The notice maintains that since Kitab had ceased to exercise the powers of the President, he had no authority under the JKCA Constitution to convene such a meeting.
The JKCA has consequently declared the proposed Special General Meeting notice null and void, withdrawn it with immediate effect and instructed all members, affiliated clubs, life members, office bearers, councillors, committees and employees not to act upon it. It has also clarified that any proceedings or resolutions passed pursuant to the impugned notice shall have no legal sanctity or binding effect upon the Association.
The Association has further directed all stakeholders to conduct the affairs of JKCA strictly in accordance with its Constitution, the Apex Council’s resolution dated June 25, the notification dated June 26 and any orders passed by the competent court.(KNB)
