Court Upholds Stay on JKCA SGM, Dismisses President Javed Kitab’s Appeal

Jammu, June 29(KNB): A court in Jammu has upheld the interim stay on the proposed Special General Meeting (SGM) of the Jammu and Kashmir Cricket Association (JKCA), dismissing an appeal filed by JKCA President Javed Ahmad Kitab against an earlier order passed by the trial court.

The 1st Additional District Judge, Jammu, R.S. Jasrotia, dismissed the appeal and upheld the June 2 order of the Sub Judge/Special Mobile Magistrate, which had stayed the operation of two communications issued by the JKCA President on May 26 and May 29, 2026, relating to the convening of the SGM.

The dispute arose after JKCA Honorary Secretary Vivek Khajuria challenged the President’s decision to independently convene the SGM scheduled for June 6, alleging that the move violated the Supreme Court-approved JKCA Constitution.

According to the Secretary, Rules 15 and 17 of the JKCA Constitution empower the Honorary Secretary to formally convene meetings, circulate agendas and notify venues. He contended that the President could invoke independent powers only if the Secretary failed to act within ten days of a presidential direction. However, the SGM notice was issued merely three days after the President’s directive, allegedly breaching the prescribed constitutional procedure.

Taking note of the submissions, the trial court had observed that the Secretary had made out a prima facie case and that unilateral actions could adversely affect the democratic functioning of the association. The court subsequently granted an ex parte ad-interim injunction, staying the implementation of both presidential notices.

Challenging the order, President Javed Ahmad Kitab argued before the appellate court that the Secretary had concealed the pendency of related proceedings before an Additional District Judge in Srinagar, questioned the territorial jurisdiction of the Jammu court, and maintained that the stay on the SGM had disrupted essential administrative functions, including salary payments, vendor dues and banking operations.

After hearing the matter, the appellate court rejected the President’s contentions and upheld the interim stay. The court observed that the issues involved in the Jammu proceedings were distinct from those pending before the Srinagar court, as the present case specifically concerned procedural compliance in convening the Special General Meeting.

With the appeal dismissed, the interim stay on the SGM remains in force, pending further proceedings before the trial court.(KNB)
