Srinagar, May 25(KNB): In a significant development concerning the Jammu & Kashmir Cricket Association (JKCA), the Court of Additional District Judge Srinagar has granted interim relief in favour of the duly elected JKCA President, reinforcing the principles of constitutional governance, transparency and collective decision-making within the Association.
In a statement issued to news agency Kashmir News Bureau that the court order came after the elected President approached the court challenging certain communications and meeting notices allegedly issued unilaterally and without constitutional authority. The petition highlighted that the JKCA elections were conducted under the supervision of the Electoral Officer in accordance with the constitution recognized by the Hon’ble Supreme Court and affiliated with the BCCI.
The petitioner argued that powers vested in the office of the President were being bypassed through unauthorized communications, convening of meetings and induction of members into the Apex Council in violation of the JKCA Constitution. It was further submitted that the impugned meeting notice dated May 23, 2026 lacked presidential concurrence, mandatory notice period and procedural safeguards required under the constitution.
After hearing the matter and examining the record, the Court observed that substantial questions had been raised regarding the competence and authority behind the impugned communications. The Court noted that the plaintiff had made out a prima facie case and that failure to protect the petitioner’s rights at this stage could result in irreparable loss.
Accordingly, the Court stayed the operation of Communication No. JKCA/Secy/JMU/2026/06 dated 22-05-2026 as well as the meeting notice issued vide Communication No. JKCA/Secy/JMU/2026/10 dated 23-05-2026 until the next date of hearing.
The Court also discharged the caveat filed earlier, observing that it was not maintainable in law.
The order is being seen as a major boost for institutional accountability and constitutional functioning within JKCA. Sources close to the elected body stated that the President’s intervention was aimed at safeguarding the integrity of the Association, protecting democratic processes and ensuring that JKCA functions strictly within the framework of its constitution and BCCI-recognized norms.
The matter is now listed for further hearing on June 2, 2026.(KNB)
