Srinagar 06 October (KNB); The government of J&K on Wednesday in its order directed all employees to follow a stipulated time period with regard to any matter connected to their service rights or conditions, which they seek to present before competent authorities for redressal.
The order copy lying with KNB reads that “It has been observed that in service matters, applications/claims are being presented by a Government Servant to Competent Authorities for consideration aher delay of a considerable period of time. Such stale claims are not legally tenable, as such are not required to be entertained by the concerned Department.”
It further said that in this regard, the law has been laid down by the Supreme Court of India. The order also cited several judgments pertaining to the matter.
“It is, therefore clarified that whenever, in any matter connected with his/her service rights or conditions, a Government servant wishes to press a claim or to seek redress of an alleged grievance, the same should be addressed to the competent authority concerned within a stipulated period of six months from the date the alleged grievance has arisen, or any other period specifically provided in any rule, regulation or law whichever is later, after which the same shall be treated as time-barred,” reads the order.
However, it further said that it is enjoyed upon all the Administrative Department not to entertain any such claims which are time-barred and close all such old cases which cannot be resolved on account of inordinate delay. (KNB)
